Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pinzzo (the "App," "Service"), operated by Pinzzo ("we," "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Pinzzo.

1. Eligibility

You must be at least 16 years old to use Pinzzo. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and keep it up to date. We may suspend or terminate accounts that violate these Terms.

3. The Service and how it works

Pinzzo lets users leave location-tagged content ("pins") that other users can discover only by being physically present at that location, subject to the visibility and privacy settings described in our Privacy Policy. Features may change, and we may add, modify, or remove features at our discretion.

Location and physical safety

This includes:

• Being aware of your surroundings, traffic, and physical hazards while using the app.
• Not trespassing on private property, restricted areas, or anywhere you do not have a legal right to be, in order to create or discover a pin.
• Exercising caution when meeting other users in person, whether arranged through the app or otherwise.

Pinzzo does not verify the safety of any location associated with a pin and is not responsible for what happens to you while traveling to, from, or at any location referenced in the app.

4. User content

Your content, your ownership

You retain ownership of the photos, videos, audio, text, and other content you submit ("User Content"). By submitting User Content, you grant Pinzzo a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it as necessary to operate the Service — including showing it to other users who discover your pins, are shown it via sharing features, or view it in accordance with your chosen visibility settings.

Your responsibility for your content

You are solely responsible for your User Content and confirm that you have the necessary rights to post it and that it does not violate any law or third party's rights.

Prohibited content and conduct

You agree not to:

• Post content that is illegal, defamatory, harassing, hateful, sexually explicit involving minors, or that infringes another person's intellectual property or privacy rights.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use GPS spoofing, emulators, bots, or any other method to falsify your location or otherwise circumvent the App's proximity-based discovery mechanic.
• Harass, stalk, threaten, or attempt to physically locate another user against their wishes.
• Attempt to farm pins, discoveries, streaks, or leaderboard rank through automated means or by abusing the platform's mechanics.
• Interfere with or disrupt the Service, or attempt to access it through unauthorized means.

Reporting and enforcement

Pinzzo provides in-app tools to report content or users, and to block other users. We review reports and may remove content, suspend, or terminate accounts that violate these Terms, at our discretion and without prior notice in cases of serious violations. If you believe content violates these Terms, you can report it via the in-app reporting tool or contact us at [email protected].

5. Intellectual property

Pinzzo's name, logo, app design, and underlying software are owned by us and protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, branding, or proprietary technology outside of your normal use of the Service.

6. Copyright infringement claims

If you believe content on Pinzzo infringes your copyright, please send a notice to [email protected] including: (a) identification of the copyrighted work, (b) identification of the allegedly infringing material and its location in the app, (c) your contact information, (d) a statement of good-faith belief that the use is unauthorized, and (e) a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner. We may remove content in response to valid notices and may terminate accounts of repeat infringers.

7. Subscriptions and payments

Pinzzo offers optional paid subscriptions ("Premium") providing additional features described in the app. Subscriptions are billed and managed through the Apple App Store or Google Play, as applicable. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period, through your Apple or Google account settings. Refunds are subject to Apple's or Google's respective refund policies, not ours — we do not process payments or refunds directly.

8. Third-party services

Pinzzo relies on third-party services (including mapping, push notifications, GIF search, and payment processing) to operate. We are not responsible for the content, policies, or practices of these third parties, though we select them with care and describe relevant data sharing in our Privacy Policy.

9. Disclaimer of warranties

10. Limitation of liability

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold Pinzzo harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at our discretion, including for violations of these Terms, without prior notice where we reasonably believe this is necessary to protect the Service or its users.

13. Governing law and disputes

These Terms are governed by applicable law, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service shall be resolved through the courts of competent jurisdiction, except where mandatory consumer-protection law gives you the right to bring a claim in your own country of residence.

14. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
